These terms and conditions govern the sale of products on donatif.com hereinafter referred to as the seller.
The customer declares to have read the contractual information expressly stated on our website, to which he/she must refer even for purchases made through another channel (e.g. Whatsapp, e-mail or other) and to fully accept the conditions below.
The seller may at its sole discretion reject the order, even partially.
Products on pre-sale can only be paid for in advance via the payment methods listed below.
Receipt of theorder is confirmed by the seller by sending an e-mail to the e-mail address communicated by the customer. It is the customer's obligation to correct any compilation errors promptly by sending an e-mail to info@donatif.com.
All prices on donatif.com include VAT.
The customer has a choice of the following payment methods:
- Scalapay: if you buy with Scalapay you receive your order immediately and pay in 3 instalments for a maximum amount per order of 3,000 euro. You acknowledge that the instalments will be transferred to Incremento SPV S.r.l., related parties and their assignees, and that you authorise this transfer.
- Soisy: Thanks to payment with Soisy, you can choose to pay for our products in up to 24 instalments for a maximum amount per order of EUR 5,000.
- Grenke: Grenke is an operating lease that allows you to pay in instalments of up to 60 months for a maximum amount per order of EUR 100,000.
- PayPal: PayPal is one of the world's most popular payment systems that allows you to pay quickly via your PayPal account.
- Cash on delivery: payment in cash directly to the courier during goods delivery, there is an additional fixed cost of EUR 9.99 plus a variable cost of 2% of the total order amount (payment method only available in Italy).
- Bank Card: credit, debit and prepaid cards are accepted. Some of the valid circuits are: Visa, Mastercard, Maestro, Postepay, Discover, Aura, American Express. The seller or third parties will never be aware of the customer's card details as they are securely processed by VivaWallet bank's advanced technology.
- Bank transfer: when the order is completed, the customer will receive an e-mail with the name and bank details indicated. The time required to receive goods with this payment method can take up to 3 working days.
Delivery times for goods in stock are 2-3 working days forItaly and 5-7 working days for the rest ofEurope.
For shipments outside Europe, delivery times vary according to product and country.
Delays may occur due to lack of availability of the product, special customer requests, force majeure.
The seller is not responsible for any delays in order delivery.
The customer shall not be able to cancel the order for any delays not caused by the seller, except for a delay of more than twice the stated time.
On the day the customer places his order, he shall receive an e-mail from info@donatif.comand a text message or e-mail indicating traceability.
Upon delivery of goods by courier, the customer is obliged to check:
- Whether the number of parcels indicated on the courier's bordereau corresponds to how many parcels are actually present
- Whether each package is completely intact
If at least one condition is not met, the goods must be collected by writing on the courier's document"collection with reservation" and you must immediately send an e-mail to info@donatif.com with explanations regarding the incident.
Once the delivery has been accepted without reservation for the receipt of the products, the customer may not make any objection regarding the lack-damage of the packages except for what must be checked by opening the packaging.
The customer isobliged to pick up the parcel in the absence of the problems listed above, in the event of refusal or absence at the time of delivery of the goods, the products will go into storage, with any redelivery costs borne by the customer, to be paid by bank transfer or other methods accepted at the time by the seller. In the absence of payment, the seller may return the goods to its warehouse, reimbursing the customer for the amount paid, less expenses incurred and any inconvenience.
It is possible to exercise the right of withdrawal within 14 days of receipt of the goods for any reason whether by private individuals or VAT holders, or within 30 days in the case of non-conformity of the goods, subject to notification of the request for withdrawal made by e-mail within 14 days of receipt of the goods.
The right of withdrawal is subject to the following mandatory conditions:
- The product must be returned in its entirety, with no missing parts.
- The shipping costs shall be retained by the seller if the request for withdrawal is made due to the customer's reconsideration, and not due to product-related problems.
- Shipping costs relating to the return of the product shall be borne entirely by the customer, who is also responsible for checking that the product has been delivered.
- Incidental costs (e.g. cost of cash on delivery or gift wrapping) willnot be reimbursed.
- It isnot possible to exercise the right of withdrawal for products where customisation, changes from the original state or created specifically for the customer have been requested (e.g. products marked with the "Made in Italy" symbol or products with a delivery time of 40-60 days). In the event of problems, shortcomings and malfunctions, the seller shall restore the product at its own expense, without giving the customer the opportunity to exercise the right of withdrawal.
The seller endeavours to guarantee accurate product information down to the smallest detail, but it may sometimes happen that characteristics other than those described may be found.
The seller is liable for failure to provide or incorrect product information that is relevant to its use. Granting the customer the right of withdrawal.
Information not of primary importance (e.g. weight of a calisthenics frame) that does not affect the use of the product cannot be a pretext for exercising the right of withdrawal or requesting a partial refund.
Made in Italy products, which are manufactured in our workshops, are expressly marked with the indicative symbol 'Made in Italy', all other products are of European or non-European import.
The seller shall issue a refund no later than 7 days after receipt of the goods, any delays are tolerated.
The seller recognises for new products the minimum warranty of 24 months for conformity defects. In order to use it, the customer must keep the purchase receipt that he/she will receive together with the purchased goods and/or by e-mail to confirm the order.
For many types of products, the seller offers a lifetime warranty on the breakage of steel parts or welds attributable to manufacturing defects. This is specified in the product data sheet.
The 24-month guarantee applies to the product with conformity defects if it has been used correctly, in accordance with its intended use (the guarantee is for the consumer, the person who buys not for his own business, and therefore does not require an invoice. The warranty for companies or associations is 12 months).
In the event of conformity defects the seller shall pay all costs for restoring/replacing the product, in the event that the seller does not find any problem or defect arising from the seller, it shall be the customer's obligation to reimburse all costs incurred by the seller in making such a claim. The seller may demand payment of the costs incurred by any means, including depreciation of the value of the goods to be refunded.
The seller shall not be liable for any delay in the replacement of goods.
The seller guarantees the customer compliance with the legislation on the processing of personal data, as governed by the Privacy Code. The personal data requested at the time of purchase are processed solely for order management purposes, even after the date of goods delivery, on special computer systems, and in no case and under no title shall they be transferred to third parties.
The customer at any time has the right to revoke consent to the processing of personal data by registered letter to be sent to the seller's operational headquarters.
TERMS:
Days or days: shall always be understood to mean working days only (Monday to Friday, excluding holidays).
Any complaints must be addressed to the seller's operational headquarters.
The sales contract between the customer and the seller is concluded in Italy and governed by Italian law. For the resolution of any type of dispute arising from the conclusion of this sales contract, the Court of PI shall have exclusive jurisdiction.
